Chamisa appeal continues today

THE hearing of a Supreme Court appeal by MDC leader Nelson Chamisa in which he is seeking to overturn a High Court ruling nullifying his presidency of the country's biggest opposition party continues today.

The appeal comes after High Court judge Edith Mushore earlier this year ruled in favour of a Gokwe MDC member, Elias Mashavira, who challenged Chamisa's leadership, which he said happened in violation of the party's constitution.

In the appeal, Chamisa and Morgen Komichi are the applicants, while Mashavira, Elias Mudzuri, Thokozani Khupe and Douglas Mwonzora are cited as respondents.

When the matter was heard yesterday, Chamisa's lawyer Thabani Mpofu applied to withdraw the appeal against Khupe, Mudzuri and Mwonzora, claiming the judgment in the matter will be of no effect to their cause.

Mpofu also claimed the record of proceedings was incomplete and needed to be rectified. He said there was need for parties to peruse a 2016 court record relating to another case in which the party's actual constitution was filed.

Mudzuri's lawyer Runouya Zimudzi and Mwonzora's representative Jon Kadoko did not oppose the application for withdrawal.

However, Khupe's lawyer Lovemore Madhuku challenged the decision to withdraw the appeal against his client, claiming she is an interested party. The Supreme Court is expected to make a determination on whether the withdrawal will succeed or not today.
