Businessman seeks Minister Chombo's arrest

Mutare businessman Tendayi Blessing Mangwiro has once again approached the High Court seeking the arrest of Home Affairs Minister, Dr Ignatious Chombo over his non compliance with court orders.

Mangwiro who won a case where he was seeking the reimbursement of his US$1.5 million which was seized from him by the police in 2008 has approached the High Court seeking the arrest of Minister Chombo.

Mangwiro through his lawyers Mahuni and Mutatu paid for a writ of civil imprisonment against Minister Chombo and petitioned the Registrar of the High Court and the Sheriff to commit the minister to prison with labour for 90 days until he complies with court orders.

The latest move by the businessman is a follow up to a court order granted in November last year by Justice Ammy Tsanga after a finding that the minister had willfully disregarded 2 court orders HC 4766/13 and HC 4261/16 to cause Mangwiro to be reimbursed his funds from the consolidated revenue fund.

The order had been stayed after the minister lodged an appeal in the Supreme Court of Zimbabwe immediately after the court order.

Mangwiro's lawyers in their letter to the registrar expressed dismay at the failure by the registrar to execute the court order for the arrest of Minister Chombo following a withdrawal of the appeal on the 22nd of March this year.

They requested that the registrar furnish the Sheriff or his deputy with the court order which is a writ of committal to prison of the minister in terms of order 43 rule 392 of the High Court rules.
