Mushore row costs council $165,000

Delays by the Labour Court in ruling in a matter pitting former NMBZ Bank chief executive Mr James Mushore and Harare City Council has so far cost council over $165 000 in salary and benefits to the former banker who held the post of town clerk for only a week.

Mr Mushore could pocket a cool $251 400 by the end of his contract.

He signed a two-year contract with Harare City Council on April 1 last year before being sent on forced leave a week later after Government rescinded the appointment, saying the appointment went against the Urban Councils Act.

According to the law in question, council was supposed to submit the names of three candidates to the Local Government Board for approval.

Harare Mayor Councillor Bernard Manyenyeni said the pending matter continued to haunt council.

"The Town Clerk issue has not seen much progress and will continue to affect council's operations," he said. "We pray for finality more than anybody else. The mayor is more desperate for a permanent resolution on this matter."

Last year, the High Court ruled that Mr Mushore was entitled to his salary and benefits and he has since threatened to sue council.

His benefits include fuel, airtime and an official vehicle.

In October last year, Mr Mushore's lawyers – Gill, Godlonton and Gerrans – wrote to the city council demanding that Harare pays him a salary.

At that time, his salary arrears were just over $70 000.

According to his contract, Mr Mushore is entitled to a monthly salary of $10 475.

Mr Mushore approached the High Court after Acting Mayor Cllr Chris Mbanga locked him out of his office.

Although the High Court dismissed his application with costs, it ruled that he was entitled to his salary and benefits and that he was not suspended.
